LOS ANGELES, CALIFORNIA: In a recent lawsuit, Oscar-winning actor Jamie Foxx, 55, is facing serious allegations of sexual assault that reportedly occurred in 2015.
The plaintiff, identified only as Jane Doe, claims that Foxx placed his hands on her waist before moving them under her top, eventually escalating to further inappropriate actions.
Jamie Foxx's night at Catch NYC & Roof takes a dark turn
The incident is said to have taken place around 1 am at Catch NYC & Roof, a popular celebrity hotspot.
According to the lawsuit obtained by the Daily Mail, the plaintiff and her friend had been seated at a table away from Foxx for a few hours before the alleged assault.
The plaintiff's friend reportedly asked Foxx for a photo, to which he allegedly responded, "Sure, baby, anything for you."
The plaintiff describes Foxx as appearing intoxicated and making comments about her appearance, stating that she looked like Gabrielle Union and praising her body and fragrance.
"Wow, you have that supermodel body," he allegedly said, adding that she smelled "so good."
The situation took a distressing turn when Foxx allegedly pulled the plaintiff to a secluded area on the rooftop. Despite the plaintiff's attempts to step away, she claims that Foxx continued his inappropriate behavior, including rubbing her breasts and, shockingly, inserting his fingers into her vagina and anus.
The plaintiff alleges she "attempted to step away and noticed a security guard and others who saw what had happened" but that they "chose to walk away." Upon the arrival of the plaintiff's friend, Foxx reportedly ceased his actions.
The plaintiff claims to have suffered both physical and emotional distress as a result of the alleged assault, seeking medical treatment in its aftermath.
She is now pursuing legal action, suing Foxx and Catch, along with its employees, for compensation and punitive damages.
The lawsuit has been filed under New York's Adult Survivors Act, a legislative measure that provides a one-year revival window for filing sexual abuse claims that would otherwise be barred by the statute of limitations.
The deadline for such claims is imminent, ending on Thursday, November 23.
Past allegations against Jamie Foxx
This is not the first time Foxx has faced allegations of sexual misconduct. In 2002, a woman claimed that Foxx had "slapped" her with his penis.
In 2018, the Las Vegas police confirmed that a female victim had alleged a sexual assault in the Las Vegas area in 2002, with Foxx named as the suspect.
Foxx's lawyer vehemently denied the claims, stating that the alleged incident was not reported to law enforcement at any point in the past sixteen years.
"Jamie Foxx emphatically denies that this incident ever occurred, and he will be filing a report with the Las Vegas Police Department against the woman for filing a false police report against him," Foxx's attorney said at the time.
"The first time Mr Foxx became aware of this woman's absurd claims about an incident that supposedly occurred sixteen years ago was when TMZ contacted his representatives today about this story," the attorney added.
"The alleged incident was not reported to law enforcement in 2002, or at any other time in the last sixteen years until last Friday because the incident never happened. We consider it to be extraordinarily reckless for any publication to publish this bogus story," the lawyer added.
Jamie Foxx's health scare
The latest allegations come seven months after Foxx's unspecified medical emergency in April, which left him hospitalized for an extended period.
In August, Foxx shared with his Instagram followers that he was finally starting to feel like himself again after the health scare.
Despite the hurdles in his recovery, he expressed gratitude for the support received, stating, "I will be thanking all of you personally… and if you didn’t know… GOD IS GOOD… all day every day."
As these disturbing allegations unfold, the legal proceedings under New York's Adult Survivors Act will likely bring increased scrutiny to the case. Foxx has yet to publicly respond to these allegations.
