The Texas man who killed eight people while carrying out a mass shooting at Allen Premium Outlets on Saturday (6 May) was terminated from the US Army training in 2008 due to a physical or mental health concern according to the US Army. The shooter, identified as 33-year-old Mauricio Garcia, entered the regular army in 2008 but was terminated three months later according to a statement provided to The Independent by Heather J Hagan, US Army Public Affairs Spokeswoman. “Mauricio Garcia entered the regular Army in June 2008; he was terminated three months later without completing initial entry training. He was not awarded a military occupational specialty. He had no deployments or awards,” Ms Hagan said. She added that the Army does not provide characterisation of the discharge of any soldier. However, an Army Official noted that Garcia was “separated” under the 2005 edition of Army Regulation 635-200 paragraph 5-17, “other designated physical or mental conditions”. Garcia’s mental health has been subject to questions after law enforcement investigating the horrific attack revealed that Garcia may have engaged with white supremacist or neo-Nazi rhetoric online. An insignia associated with right-wing groups was found on the gunman’s clothing indicating he could have embraced a far-right ideology. Though law enforcement said they had not established a motive for the mass shooting yet. Local and state law enforcement are working with the FBI and Bureau of Alcohol, Tobacco, Firearms and Explosives to determine if the shooting was racially or ethnically motivated. As of now, authorities believe Garcia acted alone in the shooting. Garcia arrived at the mall around 3.30 pm local time on Saturday armed with an AR-15-style rifle, body armour and multiple rounds of ammunition. A dashcam video circulating on social media appeared to show the gunman getting out of a grey sedan just outside the mall’s entrance and then immediately begin shooting. Allen police said that an officer attending an unrelated call at Allen Premium Outlets heard gunshots at 3.36 pm on Saturday. Eight people, ranging in age from 5 to 61, were fatally shot before Garcia was shot dead by law enforcement. An image circulating online seemingly showed Garcia lying on the ground after being shot. Police said while searching the car Garcia arrived at the Allen Premium Outlets mall in, they found multiple weapons. Initial reports say Garica formerly worked as a security guard and received firearms training. It is believed that he did not have a criminal history. The Texas Department of Public Safety said Garcia is from Dallas. An 18-year-old was told her constant exhaustion was likely caused by depression and the stress of her A-levels – only to eventually be diagnosed with a debilitating chronic illness. Elizabeth Hope, from Cheltenham, Gloucestershire, experienced painful headaches and had begun falling asleep at 5pm every day while studying for her A-levels. “My mum would wake me for dinner and then I’d maybe do like an hour’s homework, which is absolutely not enough when you’re studying for your A-levels, and then fall asleep again,” the now-27-year-old recalls. When Hope said she needed to lie down during rehearsals for the school show and stopped going to cheerleading practice because she was too tired, her parents knew there was a serious problem. “To start off with, my parents thought ‘oh she just doesn’t want to go to school’,” she says. “But I started not being able to do the things that I enjoyed, so then we realised that something was very wrong.” She visited another doctor, who found Hope was experiencing myalgic encephalomyelitis, also known as chronic fatigue syndrome or ME, a long-term illness that affects the nervous and immune systems. People with ME can experience severe pain and fatigue, as well as a range of other symptoms, making everyday physical and mental tasks exhausting, according to the NHS. Hope was so exhausted that she struggled to leave the house without using a wheelchair. “I was literally stuck in my house,” she says. “We would maybe go out to one shop and then I would have to come home. Being able to use a wheelchair was amazing for me because I could go to two or three shops or go to the park and stuff like that.” A woman of 18 told by doctors that her constant exhaustion was likely depression and A-level exam stress, was diagnosed with a debilitating chronic illness which means she uses a wheelchair, but has overcome her adversity to become an award-winning wheelchair dancer and dancing instructor. “Struggling with loneliness,” she was “really unsure” when her mother suggested she attend a wheelchair dance class in Birmingham – but it turned out to be one of the best decisions she ever made. She learnt to manage her energy levels and “fell in love with dance”, and has since gone on to perform in her wheelchair at the 2022 Commonwealth Games opening ceremony and two cheerleading world championships. “I think for people with disabilities, it’s not like you can do whatever you want, because it’s not true, but you can do things in a different way,” she says. “But I love dancing and being able to share my passion with other people is just, yes, it’s really cool”. As a dancer, Hope was soon competing and joined another two dance groups, Sun Rae Inclusive Dance and Apt Dance Theatre. She went on to win the UK ParaDance National Championships with the group and came second in the solo contest after performing to Kylie Minogue’s 2018 song “Dancing”. She also found a cheerleading group and travelled to Florida in the US, where she went on to win the world championships in 2019, in the adaptive abilities category. In early 2022, Hope received a message from a friend suggesting that she apply for an assistant dance artist job with the national disability charity Sense. “They said you can apply with a cover letter and CV or via video,” she said. “So I basically made this video about how much I love dance.” To her surprise she was invited to attend a recruitment workshop. “I was like, that was fun, but I won’t get a job because all these people are way more qualified than me,” she said. “But then I got offered the job.” Hope was initially going to turn down the job because the working hours were more than she thought she could manage, but was told they would come up with a solution. She now teaches people with disabilities to dance, from non-verbal school groups to elderly people in care homes – including a 102-year-old. “It’s just about managing my energy and pain,” she says. “So for example, I rest a lot and only work one day a week. Two of Donald Trump’s codefendants in his Georgia election subversion case have asked the judge to sever their trials from the rest of the accused – including the former president. Lawyers Sidney Powell and Kenneth Chesebro have both requested speedy trials in the case. On Wednesday, they each formally requested that their cases be separated from the wider indictment, something that – if granted – would prevent Fulton County District Attorney Fani Willis from holding one trial for all 19 defendants at once. DA Willis previously revealed her plans to hold one trial for all the accused this October. In requesting speedy trials, Georgia state law now requires Ms Powell and Mr Chesebro’s trials to begin before early November. Judge Scott McAfee has already ordered Mr Chesebro’s trial to start on 23 October, while Ms Powell’s request is pending. Mr Trump is against such a hasty timeline, employing his longtime legal tactic of attempting to slow things down and drag out the process until after the 2024 election. But now, if the cases are severed, this could lead to delays in a wider trial for the remaining defendants, including Mr Trump. The requests from Ms Powell and Mr Chesebro mark the first attempts from the defendants to try to break up the massive case into smaller individual trials. Their respective motions were filed on Wednesday as the defendants and the prosecution work to set the framework for the process. Mr Trump’s lawyers have also said that they want the former president’s case to be severed from the rest of the defendants, but they haven’t yet filed a motion to do so. Ms Powell and Mr Chesebro both deny all wrongdoing in the case. In her filing, lawyers for Ms Powell said that she “did not represent President Trump or the Trump campaign” in connection to the 2020 election and didn’t have an “engagement agreement” with Mr Trump or his campaign. “She appears on no pleadings for Trump or the Campaign,” the lawyers wrote. “She appeared in no courtrooms or hearings for Trump or the Campaign. She had no contact with most of her purported conspirators and rarely agreed with those she knew or spoke with.” Her insistence comes despite Mr Trump saying in the middle of November 2020, shortly after he lost the election, that he had “added” Ms Powell to his “great team” of attorneys working on legal challenges to the election results. When Ms Powell subsequently shared bizarre conspiracy theories that millions of votes had been flipped in an international plot to take down Mr Trump, his campaign removed her from the legal team and announced that she was “practising law on her own”. Now, her lawyers have also tried to distance herself from the other attorneys charged in the Georgia case, saying that she “went her own way” following the 2020 election and that “many of her purported coconspirators publicly shunned and disparaged Ms Powell beginning in November 2020”. The filing also argued that her legal career had shown her adherence to “integrity” and “the rule of law” while pushing the baseless claim amplified by many on the right that retired General Michael Flynn was the subject of “charges completely concocted against him by a politicized FBI”. Also on Wednesday, Mr Chesebro’s lawyers requested that the judge push Ms Willis to “disclose” the names of the 30 unindicted co-conspirators included in the indictment. Mr Chesebro was behind Mr Trump’s plan to put forward fake electors to win the electoral college and he argued that he needs the identities of the individuals in order to prepare his defence in the case. On Wednesday morning, Ms Willis filed a motion requesting that Judge McAfee advise the defendants in the case of the consequences of requesting a speedy trial, noting the demands on their procedural and evidentiary rights. “By filing their speedy trial demands in this case, the Defendants have personally, willfully and deliberately narrowed numerous options that would otherwise be available to them under Georgia law,” the filing states.
