LOS ANGELES, CALIFORNIA: Jamie Foxx responds to recent sexual assault allegations by Jane Doe accusing him of assaulting her in August 2015 on New York City's Catch restaurant rooftop.

The 55-year-old actor is the latest in a series of high-profile cases filed under New York's Adult Survivors Act (ASA) which is set to expire on Friday, 24 November.

The ASA, which provided a one-year window for survivors of assault to come forward, irrespective of when the incident occurred, has spurred a surge in legal actions.

Jamie Foxx's accuser previously filed a nearly identical lawsuit

Foxx whose real name is Eric Marlon Bishop is currently intending to file a countersuit against the accuser.

Speaking to The Independent, the 'Project Power' actor's spokesperson stated, "The alleged incident never happened. In 2020, this individual filed a nearly identical lawsuit in Brooklyn."

"That case was dismissed shortly thereafter. The claims are no more viable today than they were then," the spokesperson added.

"We are confident they will be dismissed again. And once they are, Mr Foxx intends to pursue a claim for malicious prosecution against this person and her attorneys for re-filing this frivolous action," the spokesperson continued.

In the legal filing, Jane Doe has also named the restaurant, its employees, and Mark Birnbaum, the co-founder of Catch Hospitality Group as defendants.

The complainant seeks a trial by jury as well as compensatory and punitive damages.

What are the allegations against Jamie Foxx?

On the night of the alleged incident, the plaintiff and a friend sat at a table next to Foxx and Birnbaum, as per the legal filing.

The woman stated she asked the actor for a selfie and he responded, "Sure baby anything for you."

At the time, the 'Day Shift' actor complimented the plaintiff as he said, "Wow, you have that supermodel body” and “You smell so good," according to the lawsuit.

She alleged that Foxx then guided her to a secluded area of the rooftop where the alleged assault took place.

The lawsuit claims that a security guard who is also listed as a defendant in the case witnessed the assault but did not intervene.

Following the incident, the plaintiff "suffered and continues to suffer severe emotional distress and anxiety, humiliation, embarrassment, post-traumatic stress disorder, and other physical and emotional damage," read the documents.

The legal filing claims that Birnbaum and Catch NYC enabled the alleged assault and they failed to adequately supervise their restaurant employees.
