CHARLOTTE COUNTY, FLORIDA: A Florida man has been taken into custody after police found his dead mother's body decomposing inside their home. Justin D Carver allegedly failed to report to a medical examiner about the death of his mother, Layni Carver, 55 and also resisted a cop without violence.

On May 5, a welfare check was requested at a Turbak Drive residence in Punta Gorda and officers responded to the call and arrived at the scene just before 5 pm, according to the Charlotte County Sheriff’s Office. In a press release issued on Monday, May 7, the sheriff's department stated, "After knocking multiple times with no response, deputies investigated the perimeter, and noticed a foul odor emitting from the residence."

Cops 'observed multiple flies' on the door

After the cops arrived at the residence, they "observed multiple flies on the east door." As per the affidavit of probable cause, the lead officer identified as Deputy First Class (DFC) Sganga "observed a white male subject, wearing black crocs," when he looked through a window. He then tapped on the window and the man identified as Carver immediately locked the door behind him after he walked out the eastern door, reported Law and Crime.

"Deputies noticed Carver’s evasive behavior and began to question him about the well-being of the victim," stated the press release. The affidavit alleged that the 36-year-old "immediately sat himself down on the top stair of the doorway and was staring at the ground."

Sganga wrote that Carver was asked about the last time he saw his mother. He allegedly responded that it was sometime earlier in the week but that he couldn’t remember exactly when.

The deputy and the defendant then allegedly went back and forth about whether law enforcement might be able to access the house. Carver allegedly said he did not have a key and locked the door behind him. Sganga then pressed, the affidavit says, and asked the defendant how he got inside in the first place. Carver allegedly did not respond – prompting the deputy to push further.

Carver's mother was 'in a stage of decomposition on the floor'

Carver was then asked about the last time he saw his mother to which he responded that he saw her sometime earlier in the week and that he could not recollect when exactly it was. After he misguided the cops through different rooms in the home, he waited outside with another officer while Sganga conducted a search into the residence.

"Once inside the home, deputies were able to locate the victim in a stage of decomposition on the floor of one of the bedrooms," stated the press release. Carver was questioned again after he was detained. He later told the officers that there was a no-contact order taken out against him by the victim. He was also asked whether he noticed the smell and he told them he did. The defendant then admitted that he discovered his mother died two days before the welfare check.

"Justin was asked why he did not notify law enforcement, after finding the deceased, and he stated, ‘I don’t know,’ and proceeded to shrug his shoulders and look down at the ground," stated the affidavit. Carver is currently booked into the Charlotte County Jail and is scheduled for his second court appearance on May 24.
